Such a solution would , in fact , raise constitutional issues in some member states , in which it is not possible to prohibit access to the courts , even if only as a last resort , and would open the way for an interpretation of what is a question of law and what is a question of fact in this type of contract which , in my opinion , would vitiate the efficiency and speed of the system. une telle solution susciterait en plus des questions de constitutionnalité dans certains États membres où il n'est pas possible d'interdire l'accès aux tribunaux , même en dernier recours , et ouvrirait la voie à une interprétation entre ce qui est une question de droit et ce qui est une question de fait dans ce type de contrats ; ce qui porterait préjudice , à mon avis , à l'efficacité et à la célérité du système.
